18 October 2018 Brazil: Rio de Janeiro Government establishes tax amnesty program On 21 September 2018, the State of Rio de Janeiro in Brazil published Supplementary Law No. 182 (the Law), establishing a tax amnesty program for tax debts due up to 30 June 2018. The tax amnesty program applies to taxes that are administered by the Rio de Janeiro State Treasury Office and by the Attorney General’s Office (essentially State Tax – ICMS), as well as debts from fines imposed by the Accounting Court of State. Under the tax amnesty, fines and interest will be reduced, but the reductions will vary according to the discharge method chosen by the taxpayer, which may be in cash or up to 60 installments. Interest reductions may range from 15% to 50%, while penalty reductions may be from 40% to 85%. According to the Law’s text, taxpayers must request participation in the tax amnesty program within 30 days after the Rio de Janeiro Tax Authorities issue regulations to implement the Law, which has not yet occurred.
