Why register for this webcast? Determining the customs value of imported goods can be challenging, especially given recent developments in the European Union and United Kingdom. Several court cases of the Court of Justice of the European Union shed new light on the use of statistical values to prevent undervaluation. Ample room is provided to customs authorities to detect and determine customs values based on statistical values, resulting in the question of what traders can do to support their declared customs values. The publication of the final decision in the Hamamatsu case by the highest German Fiscal Court and a recent notice of the UK’s HM Revenue and Customs on the interplay between transfer prices and customs values revive the discussions about determining customs values in intercompany sales transactions. Several customs authorities have recently started reassessing import duties, claiming purchase orders issued by a customer in a back-to-back order situation can be regarded as a basis to determine the customs value, raising (again) the question of what sale is relevant in a series of sales.
